The impact of COVID-19 on efficiency in international arbitration Webinar 7 July
The Queen Mary University of London and Pinsent Masons Survey on Efficiency in International Arbitration was very much debated when its results were released last autumn. Since then the outbreak of the COVID-19 pandemic has forced some changes in the way international arbitrations are conducted. We will look at some of the changes by reference to the topics covered in the survey, in particular, whether efficiency in international arbitration has entered a new age – at the expense of fairness? Our panel of experts will share their thoughts and experiences after several months of COVID-19 induced changes.

Arbitral organisations respond to coronavirus (COVID-19)—ICC
Providing an insight into its forthcoming business, the ICC states that the majority of hearings scheduled to take place via the centre in July will leverage technology to facilitate both fully digital and hybrid solutions for case hearings, with options including a range of IP and cloud-based video conferencing platforms. The centre is available to provide assistance with platforms, which are generally used for hearings of no more than three days.

Restrictions on travel and movement imposed by governments all over the world have meant that the conduct of legal proceedings has had to change in a short time. While lockdowns are being eased in certain countries, social distancing largely remains and continues to present challenges to the smooth running of legal proceedings. Managing disputes in the future
The lockdown has forced lawyers to embrace technology in an unprecedented manner. Hopefully, positive experiences with technology will lead to it being adopted more widely to manage disputes more efficiently. However, the focus has been on virtual hearings and lawyers may think that this ‘expertise’ is sufficient. There are more valuable lessons to take away from this experience and it is crucial that lawyers build on the new knowledge that has been acquired and do not rest on their virtual hearing laurels.
